UVBrite Extended Warranty - Terms and Conditions

 

THIS WARRANTY COVERS PURCHASED LIMITED LIFETIME WARRANTY SERVICE

For an additional cost, which you included in your purchase upon check out, you have availed of Limited Lifetime Warranty (“Warranty”) on UVBrite Product.

UVBrite warrants the UVBrite branded products and accessories contained in the original packaging (“UVBrite Product”) against defects in materials and workmanship when used normally in accordance with UVBrite’ published guidelines, for the lifetime of the ownership of UVBrite from the date of original retail purchase by the end-user purchaser. UVBrite published guidelines include but are not limited to information contained in technical specifications, user manuals and service communications. This warranty extends to the original consumer purchaser only and is not assignable or transferable.

This Warranty does not apply: (a) to damage caused by accident, abuse, misuse, fire, earthquake, natural disaster, insufficient or excessive electrical supply, abnormal mechanical or environmental conditions, any unauthorized disassembly, repair, or modification or other external cause; (b) to damage caused by operating the UVBrite Product outside UVBrite published guidelines; (c) to damage caused by service performed by anyone who is not a representative of UVBrite; (d) to a UVBrite Product that has been modified to alter functionality or capability without the written permission of UVBrite; (e) to a UVBrite Product of which the original identification or date of manufacture information has been altered, obliterated or removed; or (f) to defects caused by normal wear and tear or otherwise due to the normal aging of the UVBrite Product.

Subject to the conditions and limitations set forth herein, UVBrite will, at its option, either repair or replace UVBrite Products that prove defective by reason of improper workmanship or materials. Repaired parts or replacement UVBrite Product will be provided by UVBrite on an exchange basis, and will be either new or refurbished to be functionally equivalent to new. UVBrite reserves the right to discontinue a UVBrite Product for any reason, without notice, at any time. If a UVBrite Product that has been discontinued proves defective and if UVBrite is unable to repair or replace the UVBrite Product within the terms expressed in this Warranty, a substitute UVBrite Product may be provided at UVBrite’ election, as a replacement for such original discontinued UVBrite Product.

Please follow UVBrite’ procedures for obtaining warranty service. To commence redeeming your Warranty, please first send an email to Customer Support using the information provided below to receive the Warranty Claim Form. Customer Support will require you to furnish proof of purchase details and to respond to questions designed to assist with diagnosing potential issues. Once Customer Supports makes a preliminary assessment that your UVBrite Product is covered by this Warranty, you will be provided with clear email instructions for shipment and the proper address to ship your UVBrite package. Please insure any merchandise when returning. We are not responsible for damaged, lost or stolen items from mail carriers.

Before receiving warranty service, UVBrite representative subjects the UVBrite Product to actual final inspection to determine if it is covered by this Warranty. UVBrite reviews all warranty claims on a case-by-case basis and if determined to be covered by this Warranty, UVBrite will determine whether repair or replacement will be issued. A UVBrite representative will help determine whether your UVBrite Product requires service and, if it does, will inform you how UVBrite will provide it.

UVBrite will provide warranty service through the following method:

Mail-in service. To fully determine if your UVBrite Product is eligible for service under this Warranty, you will need to ship your UVBrite Product at your expense, in accordance with UVBrite’ instructions and the UVBrite Product shall be subject to final inspection. Once service is complete, UVBrite will return the UVBrite Product to you. UVBrite will pay for shipping to your location if all instructions are followed and if the UVBrite Product is covered by this Warranty.

The Warranty applies to all costs of material and labor only, it does not cover any shipping and processing fees. If your UVBrite Product is covered under the Warranty you still have a fee to cover shipping and processing fees. You should prepay all postage, shipping, transportation and insurance fees.

UVBrite reserves the right to change the method by which UVBrite may provide warranty service to you, and your UVBrite Product’s eligibility to receive a particular method of service.

TO THE EXTENT PERMITTED BY LAW, THIS LIMITED LIFETIME WARRANTY AND THE REMEDIES SET FORTH ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED. This limited lifetime warranty may not be EXPANDED OR EXTENDED BY ANY ORAL REPRESENTATION, WRITTEN sales information, advertising, drawings or otherwise. YOUR remedies shall be limited to those provided in this limited lifetime warranty to the exclusion of ALL other remedies, including, without limitation, incidental or consequential damages.

Except as expressly set forth above, UVBrite extends no warranty of any kind, express or implied, and disclaims ALL STATUTORY AND IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANT ABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS, TO THE EXTENT PERMITTED BY LAW. Under no circumstances will UVBrite be liable under any tort, negligence, strict liability, contract or other legal or equitable theory, or for incidental or consequential damages. IN SO FAR AS SUCH WARRANTIES CANNOT BE DISCLAIMED, PERROPAL LIMITS THE DURATION AND REMEDIES OF SUCH WARRANTIES TO THE DURATION OF THIS EXPRESS WARRANTY AND, AT PERROPAL’ OPTION, THE REPAIR OR REPLACEMENT SERVICES DESCRIBED ABOVE.

EXCEPT AS PROVIDED IN THIS WARRANTY AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERROPAL IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOSS OF USE; LOSS OF REVENUE; LOSS OF ACTUAL OR ANTICIPATED PROFITS (INCLUDING LOSS OF PROFITS ON CONTRACTS); LOSS OF THE USE OF MONEY; LOSS OF ANTICIPATED SAVINGS; LOSS OF BUSINESS; LOSS OF OPPORTUNITY; LOSS OF GOODWILL; LOSS OF REPUTATION; OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE HOWSOEVER CAUSED INCLUDING THE REPLACEMENT OF EQUIPMENT AND PROPERTY.

If any term is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired. This Warranty is governed by and construed under the laws of the United States of America. UVBrite or its successor in title is the warrantor under this Warranty.
